Terms and Conditions
1. Application
1.1. Information on how to enter the 2025 Auburn Botanic Gardens Wombat Naming Competition (“ Competition ”) and a description of the prize form part of these Terms and Conditions (“ T&Cs ”).1
1.2. By entering the Competition, you agree to be bound by these T&Cs.
1.3. The promoter is Cumberland City Council (“ Council ”), located at 16 Memorial Avenue, Merrylands, NSW, 2160.
1.4. This Competition is a gratuitous lottery (game of skill) and does not require a permit under NSW law. For more information, refer to the NSW Fair Trading website (https://www.fairtrading.nsw.gov.au).
2. Eligibility and How to Enter
2.1. The Competition will open for entries at 9:00am (AEST) on Monday, 2 June 2025 and concludes at 12:00pm (AEST) on Friday, 4 July 2025 (“ Competition Period ”).
2.2. To be eligible, you must:
2.21. submit a unique name suggestion for the resident wombat at Auburn Botanic Gardens via the official entry form during the Competition Period; and
2.2.2. be over 18 years of age, or if under 18, have the consent of a parent or legal guardian (“ Entrant ”).
2.3. Only one entry per Entrant is permitted.
2.4. Employees and contractors of Council and their immediate family members are not eligible to enter or win.
2.5. Council reserves the right to verify the identity and eligibility of entrants and to disqualify any entry that does not comply with these T&Cs.
2.6. All entries become the property of Council and may be used in future promotional and public materials.
3. Judging and Prizes
3.1. All valid entries will be judged based on creativity, originality, and relevance to the wombat and the Auburn Botanic Gardens.
3.2. The top five name entries will be selected by a panel of judges from within Council (“ Panel ”).
3.3. The top five name entries will be announced at 12:00pm (AEST) on Monday, 7 July 2025.
3.4. The decision of the Panel is final, and no correspondence will be entered into.
3.5. Members of the public will be required to vote for their favourite name entry from the top five name entries selected by the Panel.
3.6. Public voting will open at 12:01pm (AEST) on Friday, 4 July 2025 and will close at 12:00pm (AEST) on Friday, 18 July 2025.
3.7. Individuals who vote will have their names automatically entered into a draw to win a $50 voucher.
3.8. The winning Entrant will win a $100 voucher.
3.9. Both winners (clause 3.7 and 3.8) will be notified by phone and/or email by Friday, 25 July 2025.
3.10. If the prize remains unclaimed after seven days, an alternate winner may be selected.
3.11. Prizes are not transferable or exchangeable and are not redeemable for cash.
4. Risk and Liability
4.1. Council is not liable for any loss, damage or injury arising from entry into the competition or acceptance of any prize.
4.2. Council may cancel, modify or suspend the Competition if it becomes necessary due to circumstances beyond its control.
5. Privacy
5.1. Council collects personal information in accordance with its Privacy Management Plan and the Privacy and Personal Information Protection Act 1998 (NSW).
5.2. Your personal information will be used to administer the Competition, contact winners, and for promotional purposes related to the Competition.
5.3. By entering the Competition, you consent to the use of your name and suburb being published in Council communications.
6. Governing Law
6.1. These T&Cs are governed by the laws of New South Wales.
6.2. Entrants submit to the non-exclusive jurisdiction of the courts of New South Wales.
