Child Safe Creative Competition - Terms and Conditions

General Terms

  1. All information on how to enter this competition forms part of these terms and conditions of entry. Entry into this competition is deemed acceptance of these terms and conditions.
  2. This competition is run by Cumberland City Council (ABN 22 798 563 329) of 16 Memorial Ave Merrylands NSW (Promoter).
  3. The Promoter reserves the right at any time to disqualify any individual who the Promoter reasonably believes has breached any of the terms and conditions or engaged in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of the competition.
  4. The Promoter is not responsible for any incorrect or inaccurate information or for any fault in the equipment utilised in this competition which may result in error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alterations of entries.
  5. The Promoter may suspend, cancel, or vary the competition at any time. The Promoter will not be responsible for any loss incurred by the entrant in relation to such suspension, cancellation, or variation.
  6. To the extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the competition or accepting or using any prize.
  7. By entering this competition, the entrant releases the Promoter from, and indemnify the Promoter against all liability, loss, damage, or injury arising from or in connection with this competition, winning or prize.
  8. Child protection is serious issue impacting many children and young people in all settings. If the entrant or someone the entrant knows is experiencing issues around child abuse or neglect please the Promoter has included information on the NSW Child Protection Helpline (PH 132 111), Police and Ambulance (PH 000) and the Kids Helpline (PH 1800 55 180).
  9. The Promoter takes child protection seriously. Entrants are not to disclose, depict or represent sensitive material or content in the Entry Form or the Artwork including child abuse or neglect. The Promoter has the right and responsibility to contact relevant Government authorities or oversight bodies if any material submitted by the Entrant indicates a risk of significant harm to a child or young person or any concerns are their safety, as per NSW child protection legislation.

How to Enter

  1. To be eligible to enter this competition, the entrant must be under the age of 18 years and a resident of Cumberland City Local Government Area or be a current student that attends a school or education and care centre in the Cumberland City Local Government Area. Additionally, children enrolled and attending Cumberland City Council’s Parramatta West OOSH service are also eligible to enter.
  2. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize and winning may be withheld unless and until the Promoter is satisfied with the verification.
  3. Employees of the Promoter and their immediate family members are not eligible to enter this competition.
  4. Entrants must submit their entries in accordance with the instructions stated on the Child Safe Creative Competition Entry Form (Entry Form). All details on the Entry Form must be completed in full and be legible. Entrants must seek their parent / guardian’s permission before entering the competition. The parent / guardian must give consent by signing the Entry Form.
  5. Entrants are required to upload and send a high-resolution digital image of their artwork in JPEG format.
  6. Entries open at 9am AEST on Sunday 05 September 2021 and close at 5pm AEST on Sunday 17 October 2021. No responsibility will be accepted for late, lost, or misdirected entries.
  7. Only one entry per person will be accepted. All subsequent entries will be deemed invalid.
  8. The entry (Artwork) must be the entrant’s own work. By entering the competition, the entrant warrants that the Artwork does not infringe the intellectual property rights of a third party. Entries that infringe intellectual property rights are automatically disqualified from the competition. The entrant indemnifies the Promoter against any costs that the Promoter may incur as a result of any intellectual property right infringement.
  9. The Artwork can take any form that is reasonable and possible to use for 2D and digital online use, printing and signage which includes; drawing, painting, photograph or original graphic design.
  10. Photography submissions which contain people who can be identified, need to submit a photography and video consent form (available on Council’s website) for each person. If the person is under the age of 18, a parent or guardian is required to sign the photography and video consent form on their behalf.
  11. The entry form features key themes that must be included in the artwork to ensure eligibility.
  12. By entering into this competition, the entrant grants the Promoter a non-exclusive, fee-free licence to use, reproduce, modify, adapt, edit, publish, and communicate the Artwork to the public.
  13. The entrant agrees that the Promoter may use the Artwork, the entrant’s name and/or the entrant’s image in any media or on any material relating to or arising out of the competition.
  14. The Promoter reserves the right to verify the validity of the entries and to disqualify any entrant for tampering with the entry process or submitting an entry that is not in accordance with these terms and conditions.

Judging and announcement of winners

  1. Each entry will be individually judged by the Promoter.
  2. Entries will be judged based on alignment to the theme and creativity and artistic consideration. The Promoter’s decision is final, and no correspondence will be entered into.
  3. Judging will take place 18 October 2021 – 2 November 2021.
  4. At least one winner will be selected from each of the following age groups; 0 – 6 years, 7 - 12 years and 13 – 17 years. If there are inadequate or insufficient entries within a certain age group, the Promoter reserves the right to select additional winners from other age groups. 
  5. Winners will be notified of their winning by telephone or email by 9 November 2021 and invited to any related possible events. The Promoter is not responsible for any travelling costs to and from any possible events.
  6. If the winner cannot be contacted within a reasonable time, a supplementary winner may be selected at the Promoter's discretion.

Winning

  1. Up to five artworks will be selected as winning artwork/s.
  2. The overall winning artwork/s will appear on signage throughout the Cumberland City Local Government Area and online on the Cumberland City Council website and social media platforms.
  3. The Promoter reserves the right to use the winning artwork in other media including posters, Council documents and promotional material.
  4. In the event that having the artwork appear on signage becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to display the artwork elsewhere or not use it, subject to any applicable laws or written directions made under applicable legislation.
  5. The decision of the Promoter regarding any aspect of the competition is final and binding and no correspondence will be entered into.
  6. The overall winners will receive one gift card each (valued at $50 each).
  1. Any ancillary costs associated with redeeming the prize are not included.
  2. The prize is not exchangeable, transferrable or redeemable for cash.
  3. In the event that a prize becomes unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.

Privacy Protection Notice

The Promoter is collecting the entrant’s personal information in order for the entrant to enter into the competition and for the Promoter to decide the winner(s) of the competition. The intended recipient of the information is Cumberland City Council. While the supply of this information is voluntary, the personal information provided will enable the entrant to enter into the competition. The personal information can be accessed by entrant and may also be available to third parties in accordance with Cumberland City Council’s privacy management. The entrant may make an application for access or amendment to personal information held by the Promoter. The Promoter will consider any such application in accordance with the Privacy and Personal Information Protection Act 1998 and the Privacy Act 1998.
